Privacy Policy

The Conseil de la magistrature du Québec (the Council) is an independent body tasked, under the Act respecting the courts of justice, with receiving and reviewing written complaints from any person against a judge for alleged breaches of the Judicial Code of Ethics.

This Privacy Policy (the “Policy”) is intended to inform you of the practices implemented by the Council regarding personal or otherwise confidential information, in accordance with the Access to documents held by public bodies and the protection of personal information Act (the “Access Act”) and any other applicable law or regulation.

This Policy applies only to information exchanged through the Council's website. This site contains hyperlinks to various other websites, including those of Québec government ministries and agencies. By clicking on one of these links, please be aware that the information exchanged is no longer governed by this Policy, but by the privacy policy of the website you visit.

 

What information is collected?

The Council's website does not use cookies. Your browsing experience on our site is therefore entirely private.

When you complete the complaint form and submit it by email or post, the Council collects identifying information (for example: gender identity, name, mailing address, email, phone number) and any information required to process your complaint. Please note, however, that the entire form and any supporting documents you deem relevant to your complaint are retained.

When you contact the Council via email, particularly through the Contact Us section of our website, we collect the information you provide in order to respond to your inquiry and to communicate with you (name, email address, phone number, etc.).


Why do we collect your information?

When you contact us by telephone, mail, or email, the information collected allows us to:

  • Verify your identity in all communications with you;
  • Access the necessary information to process your complaint;
  • Ensure the protection of your information.

The information collected may also be used when necessary to ensure your safety or the security of our website, to meet the purposes outlined above, or when required by law.

 

Who can access your information?

Only members of the Council and authorized Secretariat staff involved in handling your file have access to your information. Authorized staff access only the data necessary to fulfill their duties.

The law permits or, in some cases, requires the Council to disclose your personal information to other organizations or individuals, for example, when required by a court order. Information is never shared with private organizations.

 

What security measures are applied to personal or otherwise confidential information?

Your information is stored in secure digital directories accessible only to authorized individuals. Our premises are also secured with restricted access systems.

Your information is used solely for the purposes for which it was collected and is archived or securely destroyed once those purposes have been fulfilled.

Council members and Secretariat staff are subject to the Personal Information Protection Policy.

 

What are your access and correction rights?

You have the right to access the personal information held by the Council that concerns you.

You also have the right to data portability, which allows you to obtain your computerized personal information in a structured and commonly used technological format. This information may also be transferred, at your request, to any individual or organization legally authorized to receive it.

Additionally, you may correct or update your personal information. To do so, you must submit a written request to the person responsible for access to documents and the protection of personal information:

Effective Date

This Policy comes into effect on October 1, 2024.
